CASTRO VALLEY (CBS SF) — A SUV carrying two adults and two children was shot at on Interstate 580 in Castro Valley Thursday afternoon, prompting authorities to close the freeway at the height of rush hour.

Officer Eric Thomas of the California Highway Patrol told KPIX 5 that authorities were alerted about a shooting on Westbound 580 near the Interstate 238 interchange around 4 p.m.

Video from Chopper 5 showed at least three bullet holes went through the windshield of the SUV. There are no reports of the driver and passengers being injured.

Authorities closed all lanes of Westbound 580 for about an hour as officers investigated and talked to the victims. Some drivers were seen standing outside of their cars as they waited for the freeway to open. The roadway reopened around 5:45 p.m.

Thomas said police are searching for a silver-colored Ford Focus in connection with the shooting. Police are not sure about the driver’s whereabouts. No suspect description has been released.

It is not known if the shooter and victims knew each other of it was an road rage incident, Thomas said.

Anyone with information in connection with this case is asked to call the California Highway Patrol at (510) 581-9028.

CASTRO VALLEY (KCBS) – Four men were arrested Thursday in connection with a shooting on Interstate 580 in Castro Valley that shut down the freeway for almost an hour as the afternoon commute began.

The men were arrested several hours after the shooting by Alameda County Sheriff’s deputies investigating a call about a suspicious vehicle, California Highway Patrol Officer Eric Thomas revealed on Friday.

The CHP has not released the names of the suspects.

Five to six shots were fired from a silver car into a black SUV on westbound I-580 between Highway 238 and the 164th Avenue exit around 4 p.m. Thursday.

“Accounts from the witness related that the car drove up next to him and opened fire,” Thomas said.

The driver was not hurt.

The CHP shut down the freeway around 4:45 p.m. to look for evidence. Investigators located and recovered one shell casing on the freeway and a stray bullet from the shooting at a house nearby, Thomas said.

Three weapons, including two stolen guns, were recovered during the arrests.

Thomas said investigators have not determined a motive for the shooting.

Right-Wing Extremist Guilty Of Attempted Murder In Oakland 580 Shootout With CHP

OAKLAND (CBS SF) — A Tuolumne County man who planned a terror attack on liberal groups faces life in prison after being convicted Monday of four counts of premeditated attempted murder of a peace officer for a shootout with California Highway Patrol offices on Interstate Highway 580 in Oakland in 2010.

Byron Williams, 48, of Groveland, who has two prior bank robbery convictions, was also convicted of three counts of being an ex-felon in possession of a firearm in connection with the 12-minute gun battle, which occurred on I-580 near the Harrison Street exit just before midnight on July 17, 2010.

Williams looked straight ahead and showed no emotion when jurors read their verdict against him today after deliberating for the equivalent of three full days. He will be sentenced by Alameda County Judge C. Don Clay on April 3.

Williams’ attorney, Eric Schweitzer, said he is “disappointed” by the verdict because he believes CHP officers, who had stopped Williams for speeding and weaving, started the gunfight by shooting Williams in the back of the head, which he said made Williams think that his life was in danger and prompted him to shoot at CHP officers in self-defense.

Schweitzer said the gun battle was “one-way for most of the time” because Williams only fired 10 shots while officers fired nearly 200 shots at him. Williams fired three shots from a 9mm handgun and seven shots from a 12-gauge shotgun, the defense attorney said.

Prosecutor Autrey James said it is not clear who fired the first shot but that he believes Williams precipitated the gun battle by pointing his gun at CHP Officer Vincent Herrick as Herrick was approaching his vehicle to question him.

James said Williams didn’t pull over when CHP officers first tried to stop him because “he was deciding what to do” and Williams admitted on the
witness stand that he planned to kill Herrick.

James said the jury “did a good job” in convicting Williams of all the charges against him because “the evidence supported every finding they made.”

Williams told investigators after the shootout that he had planned to start a right-wing revolution by going to San Francisco and killing people at the Tides Foundation and the American Civil Liberties Union, according to court documents.

Schweitzer argued that because Williams was focused on his mission to target liberal groups in San Francisco, it wouldn’t make sense for him to get sidetracked by a highway gun battle unless he thought his life was in danger.

Williams and two CHP officers suffered minor injuries in the shootout.

Inside the Toyota Tundra Williams was driving, investigators also found a .308-caliber rifle.

Schweitzer said he will appeal Williams’ convictions partly on the ground that he believes jurors should have been instructed that Williams suffered from “diminished actuality” because he couldn’t think clearly after he was shot.

Schweitzer also said he thinks that if Williams hadn’t been stopped by the CHP he wouldn’t actually have carried out his plan to kill people in San Francisco.

The defense attorney said that although Williams was upset about the BP oil disaster in the Gulf of Mexico, “he didn’t know who he had a bone to pick with” specifically and he told his mother in a letter after he was arrested that “I would have cooled off” in the morning.

CHP spokesman Sean Wilkenfeld said, “We appreciate all the hard work by the Alameda County District Attorney’s Office in prosecuting this case and we’re glad that no one was killed and this is finally resolved.”

OAKLAND (KCBS)— Oakland Police Department says a 17-year-old is dead and a 22-year-old is recovering from a gunshot wound to his leg in a pair of shootings early Monday. Police are searching for a shooter and are trying to piece together a crime scene.

An unidentified teen was spotted on the street after midnight near Highland Hospital and died a short time later in the E.R. Not long after that a 22-year-old drove himself to the hospital with a gunshot wound to his leg. Police said he’s expected to survive.

Police spokesman Frank Bonafacio suggested the non-fatal shooting may have taken place in the Grand Lake Area, but that’s still unclear. Police are looking into the possibility that they were shot around Interstate Highway 580 near 14th Avenue.

Identities of the victims have not yet been released and police have not named a motive for these shootings. Police are asking anyone who saw gunfire on I-580 around midnight to contact investigators.

Crime Stoppers is offering a reward for details. There was no freeway closure as a result of this incident.

Oakland officers happened to be at Highland Hospital a little after midnight when they were told someone had just located a 17-year-old boy in the street outside the facility suffering from gunshot wounds.

Anyone with information about the shooting has been asked to call (510) 238-3821.

CHP Aircraft Catches East Bay Motorcyclist Going 120 MPH On The Highway

SAN LEANDRO (KPIX 5) — The story of how Corey McDonah ended up in the Hayward Hall of Justice is a high-tech tale that is equal parts dumb luck, bad choices, and good police work.

With sweaty palms, and a bewildered look, he pleaded no contest to reckless driving and received a lecture from the judge.

“As bad as all this seems right now, this might be one of those things that might save your life,” the judge said.

On April 2nd, Air-37 was on routine patrol over the East Bay. It flies at any time of day, with a gyro-stabilized thermal camera, and lens capable of zooming in from several miles away.

Something caught California Highway Patrol Officer Tony Jackson’s eye: a tiny speck blowing past traffic. It was McDonah on a motorcycle, weaving in and out of the cars, at nearly double the speed limit.

“The bike is stupid fast,” McDonah said. “I’m not saying I couldn’t help myself but, you know, you buy a bike for a certain reason. Sometimes it gets you in trouble.”

Jackson shot the video from more than a mile away.

“When you’re pulling stunt like this, you never know when we’re gonna be overhead,” the officer told KPIX 5.

The plane followed him for several miles to his home in San Leandro.

At 2,000 feet and a mile away, that airplane is a speck in the sky. But with their high-tech cameras, they can see fine detail, down to the color of your shoes.

“They called me out and asked me if they knew why they were there. And then I said ‘No’ and then they pointed to the plane. And then I knew,” McDonah said.

McDonah was arrested. He said he was rushing home to go to the bathroom.

This is not the first high-profile arrest using the CHP airplane. In 2010, Sacramento Kings star Tyreke Evans was caught on camera driving 130 mph, and arrested at gunpoint.

After McDonah’s arrest, motorcycle chat forums have lit up with comments like, ‘Wow, could have been me’ and ‘That has got to suck. Make it home, crack a beer, get arrested’.

“In this case, there was video evidence to document it and certainly helped make the case strong,” said Alameda County Deputy District Attorney Tim Wellman. “Like I said, his driving at that speed put himself and others at risk. And that’s why he got the sentence he got today.”

As for McDonah, he was still smug, and somewhat apologetic.

KPIX 5: Are you sorry?

McDonah: Yeah.

KPIX 5: What lessons did you learn?

McDonah: That Big Brother is always watching. I don’t know.

McDonah was sentenced to three years of probation, 20 days with the sheriff’s work squad, and 40 hours of community service. He also must pay a $500 fine. McDonah must take a safety class or sell his motorcycle.

New Design May Reduce Bird Deaths In Wind Turbines On Altamont Pass

LIVERMORE (KPIX 5) — Each year, thousands of birds die each year because they fly into wind turbines on the Altamont Pass east of Livermore. New technology could help reduce the number of bird deaths.

The area along Interstate 580 is great for harnessing wind energy, but it is bad news for birds. That includes protected species, such as the golden eagle.

“It’s a major migratory route and a lot of raptors live there year round,” said Michael Lynes of Audubon California.

Lynes said the Altamont Pass is a death trap for birds of prey.

“What we see a lot of times is when there’s good wind there are often raptors and obviously it’s of interest to wind companies because they want to harness that wind for energy,” he said.

That’s why Alameda County is trying something new. The county will study another type of turbine, called a “shrouded” windmill, to see if its design will be less lethal to birds.

The company behind the design, Ogin, said the smaller windmill sits below a bird’s normal flight path.

Lynes likes the shrouded design for a different reason. He said birds have a tough time seeing the open blades that are on turbines now.

“Here it’s a solid object. The blades aren’t invisible [to birds] because they are spinning around,” Lynes said.

An independent researcher will track the number of casualties for at least a year to see if the design decreases bird deaths.

About 40 shrouded wind turbines will be installed for the study. There are currently more than 4,000 turbines by the Altamont Pass.

SAN RAFAEL (CBS SF) –A tanker truck crash has blocked a portion of one of Marin County’s main traffic arteries Monday, creating a backup that extended across the Richmond Bridge throughout the day.

UPDATE: Sir Francis Drake Blvd Reopened After Fuel Leaked From Overturned Tanker Monday

Sir Francis Drake Blvd. was closed in both directions shortly after 7 a.m. near San Quentin State Prison. as of Monday afternoon and the roadway might not be reopened until 10 p.m., according to the CHP.

The KCBS Traffic map shows an extremely heavy backup onto the Richmond-San Rafael Bridge the crash scene.

About ten homes in San Quentin Village were evacuated as a precaution due to the leak. The community, which is adjacent to the prison, sits just off the roadway. About 40 residents there have been asked to temporarily move out of the area.

According to authorities, most of the fuel is mow out of the first tank but that the second tanker will have to be offloaded and that may a “long time.”

“You just never know,” said CHP Office Patrick Roth. “If you get a spark that comes out of that truck, we got 1,700 gallons of gasoline that’s going to ignite.”

4,000 Gallons Of Gasoline Spilled From Monday’s Overturned Tanker Wreck On Sir Francis Drake Blvd. In Marin County

MARIN COUNTY (CBS SF) — California Highway Patrol officials said 4,000 gallons of gasoline spilled when a big-rig with two tank trailers overturned on Sir Francis Drake Boulevard near San Quentin State Prison in Marin County on Monday, prompting a closure that lasted nearly 20 hours.

According to the California Highway Patrol, Sir Francis Drake Blvd near San Quentin State Prison reopened shortly before 2:30 a.m. Tuesday.

It took until Monday night to overturn the tanker that contained two gasoline tank trailers and put it on a heavy-duty tow truck.

The driver of the big-rig, Christopher Knight, 30, of Sacramento, tried to recover the sliding trailer but completely lost control and crashed at about 7 a.m. Monday, CHP Officer Andrew Barclay said.

The crash occurred as the big-rig traveled west on Sir Francis Drake Boulevard and rolled onto its right sides, then slid across the eastbound lane.

The CHP had initially estimated about 1,700 gallons of fuel spilled from the rear trailer of the big-rig.

The company that owns the big-rig, Alliance Tank Lines Inc. of Dixon, paid a clean-up crew to respond to the spill, Barclay said.

Each of the tank trailers contained 4,000 gallons of fuel, Barclay said.

The rear trailer ruptured and spilled fuel onto the roadway. The 4,000 gallons in the other trailer that was not punctured were vacuumed into another tractor-trailer that responded to the scene, Barclay said.

Knight was not injured and was able to free himself from the truck. No other vehicles were involved in the crash, Barclay said.

PG&E shut off power in the area, including power to homes that were evacuated in the prison complex on Valley Way.

(SigAlert)

(SigAlert)

A 1,000-foot exclusion zone was established around the spill, including the 10 evacuated homes in San Quentin Village.

Sir Francis Drake Boulevard was closed between Larkspur Landing Circle and Interstate Highway 580 and traffic was diverted onto city streets, causing a backup on Interstate Highway 580 and on San Rafael streets.

“I’ve been trying to get from Marin General to this point,” said one stuck driver. “I’ve been sitting in the car for an hour and a half — still ain’t at the bridge.”

(CBS SF)

(CBS SF)

The Golden Gate Ferry Terminal at Larkspur Landing remained open throughout the day and ferry commuters were not affected, Barclay said.

The truck and trailers were removed at about 9 p.m., and crews paved the roadway before it was reopened, according to the CHP.

The California Department of Fish and Wildlife, the U.S. Coast Guard, the Central Marin and San Rafael police department, the Marin County Sheriff’s Office, the Larkspur Fire Department and the Marin County hazardous materials team all responded to the scene.

OAKLAND (CBS SF) — Thousands of people protesting the grand jury’s decision in the fatal police shooting of Michael Brown in Ferguson, Missouri marched onto lanes of Interstate 580 near Lakeshore Avenue in Oakland Monday night, blocking traffic in both directions for several hours.

The California Highway Patrol issued a Sig-alert at 8:36 p.m. for traffic stopped on eastbound and westbound Highway 580 as over 2,000 protesters took to the lanes.

CHP officers and vehicles assembled in a line in front of the protesters.

About two dozen people were seen climbing the center divide to eastbound lanes where officers were chasing them down, which led to a full shutdown of the freeway.

The California Highway Patrol reopened all lanes of the freeway shortly before 11:00 p.m.

READ: Darren Wilson’s Complete Grand Jury Testimony

The protesters started gathering at Frank H. Ogawa Plaza at 14th Street and Broadway earlier in the evening before the announcement chanting, “The whole damn system is guilty as hell. Indict, convict, send the killer cop to jail.”

More people started gathering at the intersection around 6 p.m.  and yelled, “Hands up don’t shoot” and “Black lives matter.”

Many protesters held a “die-in” in which they laid down on the street with their bodies traced with chalk on the roadway.

After the decision was announced, a large crowd continued to march up Broadway, walked through Chinatown and headed east on Seventh Street.

Small groups of people stayed at the plaza calling for peace in light of the grand jury’s decision.

Protesters attempted to enter Interstate Highway 880 from Seventh and Jackson Streets only to be blocked by police and made their way back to 14th Street and Broadway.

Shortly after 7 p.m., protesters were seen on top of an unmarked police car and spray-painted it at Seventh and Jackson streets.

Dozens of police officers were seen following the marching crowd, some in riot gear.

Protesters were also setting off fireworks, vandalizing, putting garbage cans on fire and spray-painting on buildings during the march.

People continued to walk on Broadway, turned on Grand Avenue, and entered the freeway at MacArthur Boulevard.

CHP officials are advising motorists to take state Highway 24 and Interstate Highway 880 to avoid delays.

As of about 9 p.m., cars were seen traveling on eastbound lanes and protesters were being cleared on westbound lanes, though traffic was still at a halt.

The intersection of 14th Street at Broadway and Seventh and Jackson streets were briefly blocked off but have since reopened, police said.

Dogwood, a bar located at 1664 Telegraph Ave. and about two blocks away from the plaza, was boarded up in preparation for protesters who may damage the business.

In a statement Rep. Barbara Lee said, “My heart continues to go out to Michael Brown’s family and community. I am beyond disappointed in Monday’s verdict. Like everyone in our community, I am devastated by the senseless murder of yet another black man.”

“I urge protestors to be peaceful and for the police to respect people exercising their First Amendment rights,” Lee said.

People holding signs that read “The People Say Guilty!” and “Missouri, Palestine, Justice Now!” were blocking an intersection on city streets in downtown as part of the protest.

The organized protest was in response to the grand jury’s decision announced shortly before 6:30 p.m. in the shooting death of 18-year-old Michael Brown by Officer Darren Wilson on Aug. 9 in Ferguson, Missouri.

OAKLAND (CBS SF) — A crash between three cars on Interstate Highway 580 in Oakland Sunday morning left one person dead and sent another to the hospital with major injuries.

Officers said a red Toyota Celica, around 1:30 a.m., collided with the center divider on the westbound side of the interstate near Lakeshore Avenue.

A silver BMW 745i then crashed into the Toyota, which was stopped in the roadway and was facing the wrong direction.

Officials said the driver of the Toyota was struck and killed by the BMW while standing outside his car.

Officers reported the driver of the BMW abandoned the vehicle and left the scene on foot.

When law enforcement officers arrived at the scene, they found a white Chevy Cobalt that was also involved in the crash.

Officers said the preliminary investigation shows the driver of the Cobalt, identified as Tyrone Elbeck Jr., 25, of Oakland, swerved to avoid crashing into the BMW and Toyota but collided with the center highway divider. He suffered major injuries in the crash. Officers said he was not wearing a seat belt at the time of the crash.

The CHP closed the highway as crews worked the scene. All lanes have since been reopened.

The CHP is asking anyone with information about the driver of the BMW to call an anonymous phone line at 1-800-TELL-CHP. The coroner will release the identity of the driver killed after the driver’s next of kin is notified.

OAKLAND (KPIX 5) – Police in Oakland are searching for vandals who defaced a freeway sign paying tribute to four officers who were killed on the deadliest day in department history.

According to authorities, the sign was knocked down and defaced with a red “x” sometime on Friday.

The sign honors Sgt. Mark Dunakin, Sgt. Ervin Romans, Sgt. Daniel Sakai and Officer John Hege. On March 21, 2009, all four officers were killed by a convicted felon on parole. The roadside sign was installed three years after their murders and has become a fixture along Interstate 580.

Friday’s vandalism comes after weeks of anti-police brutality protests across the Bay Area, with officers frequently facing off in skirmish lines with protesters.

In a written statement, the Oakland Police Department said, “This act of disrespect does not represent the majority of our community’s feeling about the Oakland Police Department. We have received overwhelming support in recent weeks regarding our hard work, dedication and professionalism during these difficult times. The sign will be repaired and the officers’ sacrifices will never be forgotten.”

Officers are investigating the vandalism. Police don’t have any suspects.

LIVERMORE (CBS SF) — A 52-year-old man was killed in one of two related pile-up collisions near the Altamont Pass on Interstate Highway 580 near Livermore on Saturday afternoon that left six others injured, according to the California Highway Patrol.

He was identified Sunday as Stockton resident Hayward Albright, an Alameda County coroner’s bureau deputy said.

Around 4 p.m., a blue 2006 Ford F350 pickup truck was traveling on the far left lane on eastbound Highway 580 east of North Flynn Road at speeds of between 55 and 65 mph, CHP officials said.

Traffic ahead of the pickup truck was getting heavy and coming to a stop. The driver was unable to stop the vehicle and collided with a 2003 Dodge Ram 2500 pickup truck, according to the CHP.

The impact of the collision caused the Dodge Ram to crash into a 2015 Honda Pilot that was stopped on the roadway, CHP officials said.

The crash caused a chain reaction that involved two minivans, according to the CHP.

Albright, the driver of the Dodge Ram, received CPR from an officer but was pronounced dead at the scene, CHP officials said.

The driver of a red minivan traveling behind the Dodge Ram turned left when the Dodge collided with the Ford, CHP officials said.

The red minivan ended up colliding with the left rear of the Ford, according to the CHP.

A second pile-up collision occurred soon after in which multiple vehicles turned right to avoid the initial collision, CHP officials said.

Three collisions occurred in the second pile-up incident and were moved to the right shoulder, according to the CHP.

The two left lanes were closed until about 8:30 p.m., CHP officials said.

A 46-year-old Stockton woman who was a passenger in the Dodge Ram suffered a major head concussion and was airlifted to Eden Medical Center where she was in stable condition, according to the CHP.

A 73-year-old Stockton man who was a passenger in the Honda Pilot was transported to San Joaquin General Hospital for a broken pelvis and lacerations to his face, CHP officials said.

Four other people, two who were passengers in the Honda Pilot, suffered either minor injuries or complain of pain, according to the CHP.
